SUBJECT : Clarification Insofar as TH Freight Truck Services in the Implementation of

In the implementation and enforcement of "Colorum" for TH Freight Truck Services under

1. Trucks covered by a pending Application for Extension of Validity are authorized to operate as TH freight Truck Service during the pendency of the applications;

2. Trucks covered by an Application for New/Issuance of Certificate of Public Convenience (CPC) or Petition for Dropping and Substitution filed BEFORE the effectivity of this Memorandum Circular shall be provisionally authorized to operate for a period of One Hundred Twenty (120) days reckoned from June 19, 2014 or until October 17, 2014;

2.1. For those Applications for New/Issuance of CPC filed BEFORE THE EFFECTIVITY OF THIS Memorandum Circular, they shall submit to the Technical Division or Regional Office photocopies of the Applications as there are many units applied for and upon payment of filing fee for provisional authority, the grant of Provisional Authority shall be stamped on each photocopy.

3. To facilitate the timely filing of Application for Issuance of CPC before June 19, 2014, ONLY the following documents shall be required to be filed at the time of the submission of the Application, to wit: DHCcST

3.1. Four (4) copies of Verified Application Form; and

3.2. Certificate of Registration (CR) and Official Receipt (OR) of the units applied for in the name of the Applicant or being leased by him.

Additional documentary requirements shall be submitted on the date of the hearing of the application.

4. Upon filing of the Application for New/Issuance of CPC, and payment of the filing fees, the grant of Provisional Authority shall be stamped on the application as follows:

5. Trucks covered by Application for Issuance of CPC or Petition for Dropping and Substitution filed AFTER the effectivity of this Memorandum Circular but on or before October 17, 2014 shall be given provisional authority to operate only up to October 17, 2014.

6. Trucks covered by Application for New/Issuance of CPC or Petition for Dropping and Substitution filed AFTER October 17, 2014 may be issued a Provisional Authority pursuant to Memorandum Circular No. 2012-022.

7. Upon effectivity of this Memorandum Circular, trailers need not secure a CPC, and Grantees/operators with duly franchised trailers may opt to file Petition for Dropping, if they so desire.

All issuances inconsistent herewith are hereby superseded and amended accordingly.

This Memorandum Circular shall take effect immediately days after its publication in a newspaper of general circulation in Philippines pursuant to the CAETcH
