IMPLEMENTING RULES AND REGULATIONS OF

RULE I

Preliminary Provisions

SECTION 1. Promulgation. This Implementing Rules and Regulations is promulgated pursuant to SEC. 26 of HCETDS

Definition of Terms

SECTION 3. Definition of Terms.

Whenever used in this IRR, the following words or phrases shall mean or refer, thus:

Academic freedom shall be construed on the following aspects:

For the University is the right of the University to determine for itself, on academic grounds: who may teach, what may be taught, how it shall be taught, and who may be admitted to study. Moreover, the University shall have the freedom to formulate policies relative to the student's academic stay in the University, e.g., policy on admission, retention, submission of the students to drug testing, etc.

For the faculty or instructional staff the right of the faculty member or teacher to teach the subject of his/her specialization according to his/her best lights; to hold in his/her subjects, such ideas he/she believes sincerely to be right; and to express his/her opinions on public questions in a manner that shall not interfere with his/her duties as member of the faculty or jeopardize his/her loyalty to the University. It also includes the right of the teacher/faculty member or researcher to investigate and discuss the problems of his/her science and to express his/her conclusions, whether through publication or in the instruction of students, without interference from political or administrative officials of the University, unless his/her methods are found by competent authority/ies of his/her own profession to be clearly incompetent and contrary to professional ethics and generally accepted practices.

For the students, academic freedom shall consist of, but not limited to, the following rights:

a. To conduct researches in connection with academic work, and to freely discuss and publish their findings and recommendations subject to the provisions of the Research Services Manual and the Intellectual Property and Technology Commercialization Policy Manual of the University;

b. To conduct inquiry within the campus along curricular and extracurricular activities;

c. To choose a field of study and to pursue the quest for truth; to express their opinion on any subject of public or general concern which directly affects the students or the educational system;

d. To express contrary interpretations or dissenting opinions inside and outside the classroom; HcTSDa

e. To invite off-campus speakers or resource persons to student-sponsored assemblies, fora, symposia, and other activities of similar nature;

f. To participate, through their duly elected officers, in the drafting of a new curriculum and in the review or revision of the old;

g. To participate, through their duly elected officers, in the drafting and/or revising of Students Handbook, which shall include the University rules and regulations. A copy shall be furnished to the students upon payment of reasonable charge/fee thereof and admission to the University to be determined by the Board upon the recommendation by the University President; and

h. To be free from any form of indoctrination leading to imposed ideological homogeneity.

Authorized Allowances and Fringe Benefits these refer to all mandated and additional compensations and personnel amelioration given to the officials, faculty, and non-teaching personnel of the university as approved by the SDSSU Board of Regents.

Auxiliary services refer to services pertaining to economic or profit generating activities done and/or rendered by the University other than academic such as, hostel, rentals of facilities, sale of agricultural products, garments and tailoring, cafeteria, janitorial, bookstore, and the like.

Chair and Presiding Officer of the SDSSU-Board of Regents refers to the CHED Chairperson or a Commissioner duly designated by the CHED Chairperson to serve and perform the powers and duties as regular Chair Presiding Officer.

Commission on Higher Education (CHED) is the government agency created by

Community laboratory is a community adopted by the University as part of its extension program where research and civic services are conducted by its students and/or faculty.

Councils refers to the Administrative and Academic Councils.

Distance learning is a mode of education delivery at a distance with organizational and administrative support.

Dual system refers to teaching-learning approach utilizing both the experiences gained by students inside and outside of the classrooms, sometimes called the in-school-off-school approach.

Duly recognized campus alumni association is an alumni association established and recognized by the University where each campus shall have only one (1) organization comprised of alumni from the different programs of the University Campus.

Duly recognized campus faculty association is a faculty association established and recognized by the University where each campus shall have only one (1) organization comprised of the regular faculty members/instructional staff.

Duly recognized campus student council is a student council established and recognized by the University, where each campus shall have only one (1) organization comprised of bona fide students from different programs of the University campus.

Duly recognized federation of alumni associations is the federation of the duly recognized alumni associations in the different campuses of the University which has been extended recognition by the SDSSU-Board of Regents to be the legitimate and lawful organization of its alumni.

Duly recognized federation of faculty associations is the federation of the duly recognized faculty associations in the different campuses of the University which has been extended recognition by the SDSSU-Board of Regents to be its legitimate and lawful faculty association as manifested by its

Duly recognized federation of student councils is the federation of the duly recognized student councils in the different campuses of the University which has been extended recognition by the SDSSU-Board of Regents.

Extension services refer to a function of the University and the faculty members comprised of programs, projects, studies or activities as reflected in the Research and Extension Services Manual conducted in accordance with the policies of the University conducted towards the improvement on the quality of life of the target client and further expand the social contributions of the University to the constituents in various localities of Surigao del Sur and nearby provinces.

External campus is a campus integrated to the University pursuant to the provisions of pertinent laws, rules and regulations. prLL

External stakeholders refers to the parents, the alumni, the partner and collaborating agencies.

GAM refers to the revised University Governance and Administration Manual.

Instruction refers to a function of the University and faculty members which include among others the pedagogy and academic activities necessary for the delivery of educational services to the students, professionals and other clients which are vital in the realization of the mandates, vision, mission and objectives of the University.

Internal Stakeholders refers to all the officials of the University (Board of Regents, President, Vice-Presidents, Campus Directors, Directors and Deans), the Associate Deans, Faculty, Staff and Students.

IRR refers to the Implementing Rules & Regulations

Main campus is the campus where the administrative services of the University are located and/or where the University President holds office permanently.

Officials these refer to the Board of Regents, University President, Vice Presidents, Campus Directors, Deans, Directors, consultants from other government agencies with regulatory and coordinating functions, including those in the private sectors, extending consultancy and all those as provided in the University's organizational structure.

Open-learning is the philosophy of student-centered learning adopting a great amount of flexibility in the learning process thus enabling them to learn at the time, place and pace which satisfies their circumstances and requirements.

Production is a function of the University and faculty members which covers the implementation of generating resources such as but not limited to instructional materials development and commercialization of technologies and other intellectual properties to augment the income and sustain sound financial condition of the University.

Research services is a function of the University and faculty members directed to the development, transfer, utilization and commercialization and protection of new knowledge, technologies, methods, procedures, intellectual properties and scholarly works necessary for continuing improvement in the capacity of the University in the realization of its legal mandates, vision, mission and objectives, as stipulated in the Research and Extension Services Manual.

SDSSU refers to Surigao del Sur State University.

SDSSU-Board of Regents refers to the governing board (GB) or Board of the Surigao del Sur State University.

Socialized scheme of tuition and other instructional fees refers to a scheme of pattern where rate of tuition and instructional fees are collected on the basis of family income and/or socio-economic status of the student, such that the less-economically privileged students shall pay lesser fees than students coming from more economically advantaged families.

Special trust fund refers to the total amount collected or charged from students for a specific purpose or from other sources, held in trust by the University.

Stakeholders refers to both the internal and external stakeholders of the University.

Tertiary programs refer to four or five year higher education programs in the undergraduate level and graduate programs such as master's and doctoral degrees offered by the University.

University refers to the Surigao del Sur State University (SDSSU).

University President refers to the head and Chief Executive Officer of the University duly appointed by the Board of Regents.

RULE III

Coverage, Application and Construction

SECTION 4. Coverage. This IRR shall apply to and cover the Main Campus and External Campuses and such other campuses of the University.

SECTION 5. Application and Construction. The provisions of this IRR shall be applied in order to attain the mandates, intents, vision, mission, objectives, goals and purposes of the University. SDSSU shall strive for continuing provision of quality higher education, attain greater relevance and global competitiveness and maintain its institutional autonomy and academic freedom in accordance with existing laws, rules, regulations and established jurisprudence. Thus, all doubts in the implementation of the provisions of this IRR shall be resolved in favor of the University.

In all matters affecting the welfare of the students, all doubts in the implementation and interpretation of the provisions of this IRR, shall be resolved in favor of the students subject to existing laws, rules and regulations.

In all matters affecting the welfare of teaching and non-teaching personnel, all doubts in the implementation and interpretation of the provisions of this IRR, shall be resolved in favor of the faculty members or personnel, subject to existing laws, rules and regulations.

RULE IV

Conversion and the University Campuses

SECTION 6. Conversion. The Surigao del Sur Polytechnic State College in the Province of Surigao del Sur composed of SSPSC-Tandag Campus in the Municipality of Tandag, SSPSC-Cantilan Campus in the Municipality of Cantilan, SSPSC-Lianga Campus in the Municipality of Lianga, SSPSC-Tagbina Campus in the Municipality of Tagbina, SSPSC-San Miguel Campus in the Municipality of San Miguel and SSPSC-Cagwait Campus in the Municipality of Cagwait, is hereby converted into a state university, to be known as the Surigao del Sur State University, hereinafter referred to as the University.

SECTION 7. The Main Campus. The main campus of the University shall be in the Municipality of Tandag, Surigao del Sur which shall henceforth be called as SDSSU-Tandag Campus where the University President and other organic officials of the University shall hold regular office.

SECTION 8. The External Campus. The external campuses are located in the municipalities of Cantilan, Lianga, Tagbina, San Miguel and Cagwait, in the Province of Surigao del Sur shall henceforth be called as the SDSSU-Cantilan Campus, SDSSU-Lianga Campus, SDSSU-Tagbina Campus, SDSSU-San Miguel Campus and SDSSU-Cagwait Campus.

RULE V

General Mandate, Curricular Offerings and Functions

SECTION 9. General Mandate. The University shall primarily provide advanced education, higher technological, professional instruction and training in trade, fishery, agriculture, science, education, commerce, engineering, forestry and other related fields. It shall also undertake research and extension services, and provide progressive leadership in its area of specialization. IaDSEA

SECTION 10. Curricular Offerings. The University shall offer undergraduate, graduate and post-graduate programs and short-term courses in the fields of agriculture and environment studies, fishery, marine biology, marine transportation, engineering, forestry, industrial technology, education, law, medicine, nursing, midwifery and other health-related programs, information technology, arts and sciences, public administration, business administration and other business courses, and other degree courses within its areas of specialization and according to its capabilities, as the Board of Regents may deem necessary to carry out its objectives, and in order to meet the needs of the Province of Surigao del Sur or Region XIII (CARAGA) and the nation for socioeconomic and sustainable development and competitiveness.

Provided, That no degree program shall be offered without the approval of the Commission on Higher Education before the same shall be approved by its Board.

SECTION 11. Continuation of the Curricular Offerings Prior to the University Conversion. The University shall continue the curricular offerings being offered in SDSSU-Tandag Campus, SDSSU-Cantilan Campus, SDSSU-Lianga Campus, SDSSU-Tagbina Campus, SDSSU-San Miguel Campus and SDSSU-Cagwait Campus prior to the University conversion.

SECTION 12. Requisites in the Consideration and Approval of Curricular Offerings. The following requisites shall be satisfied before the Board of Regents considers or approves any new curricular offering:

1. Feasibility study to be prepared by any faculty member or Dean of the College or any official of the University which shall be evaluated and favorably recommended by the Curriculum Committee to be chaired by the Vice President for Academic Affairs duly constituted by the University President in accordance with the provisions of the University

2. Resolution of endorsement duly approved by the duly constituted Academic Council of the University;

3. Endorsement by the University President to CHED for compliance of the minimum requirements; and

4. Approval by CHED.

SECTION 13. Requisites in the Consideration and Approval of the Curriculum Revision. A revision of any curriculum is undertaken to comply with the policies standards and guidelines or implement the recommendations by the accrediting or regulatory bodies without substantial alterations or changes on the nomenclature of the degree program or course, to wit:

1.Proposal for curriculum review to be prepared by any faculty member or Dean of the College or any official of the University which shall be evaluated and favorably recommended by the Curriculum Committee duly constituted by the University President in accordance with the provisions of this IRR and/or the University

2.Resolution duly approved by the duly constituted Academic Council of the University; and

3.Approval by the University President and Board of Regents.

SECTION 14. Retention and Operation of a Laboratory High School. The existing high schools in SDSSU-Cantilan Campus, SDSSU-Lianga Campus, SDSSU-Tagbina Campus, SDSSU-San Miguel Campus and SDSSU-Cagwait Campus shall be the high school laboratory of the Bachelor of Secondary Education under the supervision of the College of Teacher Education: Provided, That the high school shall be allowed to remain and operate within its external campuses: Provided, further, That the University may operate a reasonably sized laboratory school to serve as feeders to tertiary programs for campuses offering teacher education curriculum unless otherwise superseded by law that existing high schools shall be transferred to the jurisdiction and supervision of the Department of Education (DepEd).

RULE VI

Administration

SECTION 15. Administration. The University shall have the general powers of a corporation set forth in

SECTION 16. Chief Executive Officer. The University President shall be the Chief Executive Officer of the University whose primary duties and responsibilities are to faithfully, properly and efficiently and effectively carry out the policies, guidelines and programs laid down by the Board in accordance with existing laws, rules and regulations.

RULE VII

The Governing Board

SECTION 17. The Governing Board. The governing body of the University shall be the Board of Regents, hereinafter referred to as the Board, which shall be composed of the following:

a) The Chairperson of the Commission on Higher Education (CHED) as chairperson, or his authorized representative, as chairman designate; SAHIaD

b) The President of the University, vice chairperson;

c) The Chairperson of the Committee on Education, Arts and Culture of the Senate, member;

d) The Chairperson of the Committee on Higher and Technical Education of the House of Representatives, member;

e) The Regional Director of the National Economic and Development Authority (NEDA), member;

f) The Regional Director of the Department of Science and Technology (DOST), member;

g) The President of the Federation of Faculty Associations of the University, member;

h) The President of the Federation of Student Councils of the University, member;

i) The President of the Federation of Alumni Associations of the University, member; and

j) Two (2) prominent citizens who have distinguished themselves in their professions or fields of specialization of the University, members.

SECTION 18. Powers and Duties of the Board of Regents. The Board shall have the following specific powers and duties in addition to its general powers of administration and the exercise of all the powers granted to the Board of Regents of a corporation under existing laws:

a) To promulgate rules and regulations not contrary to law as may be necessary to carry out the purposes and functions of the University;

b) To receive and appropriate all sums as maybe provided, for the support of the University in the manner it may determine, in its discretion in order to carry out the purposes and functions of the University and the common good of its stakeholders;

c) To receive and appropriate all sums as may be provided, through incentive package award given to faculty and staff specially before the year end in recognition of extra-ordinary efforts extended and/or achievements garnered as guardians of academic excellence in the University;

d) To import duty-free economic, technical and cultural books and/or publications, upon certification by the CHED that such imported books and/or publications are for economic, technical, vocational, scientific, philosophical, historical or cultural purposes, in accordance with the provisions of the

e) To receive in trust legacies, gifts and donations of real and personal properties of all kinds, and to administer and dispose of the same when necessary for the benefit of the University, and subject to the limitations, directions and instructions of the donor, if any;

Such donation shall be exempt from the donor's tax and the same shall be considered as allowable deductions from the gross income in the computation of the income tax of the donor, in accordance with the provision of the

f) To fix tuition fees and other necessary school charges, such as, but not limited to, matriculation fees, graduation fees, laboratory fees, and other fees as the Board may deem proper to impose, after due consultations with involved sectors;

Such fees and charges, including government subsidies and other income generated by the University, shall constitute special trust funds and shall be deposited in any authorized government depository bank, and all interests shall accrue there from, shall form part of the same funds for the use of the University; CHIEDS

Any provision of existing laws, rules and regulations to the contrary; notwithstanding any income generated by the University from tuition fees and other charges, as well as from the operation of auxiliary services and land grants, shall be retained by the University, and may be disbursed by the Board for instruction, research, extension or other programs/projects of the University. It shall be used to augment the maintenance and other operating expenses and capital outlays of the University and pay authorized allowances and fringe benefits to officials, faculty, employees and students who have rendered services to the University. Provided, that all fiduciary fees shall be disbursed for the specific purposes for which these are collected;

If, for reasons beyond its control, the University shall not be able to pursue any project for which the funds have been appropriated and allocated under its approved program of expenditures, the Board may authorize the use of said funds for any reasonable purpose which, in its discretion, may be necessary and urgent for the attainment of the objectives and goals of the University;

g) To adopt and implement a socialized scheme of tuition and school fees for greater access to poor but deserving students;

h) To authorize the construction or repair of its buildings, machinery, equipment and other facilities, and the purchase and acquisition of real property, including necessary supplies, materials, and equipment;

i) To appoint upon recommendation of the President of the University, vice presidents, deans, directors, and heads of campuses, faculty members, other officials, and employees of the University;

j) To fix and adjust salaries of faculty members, administrative officials and employees subject to the provisions of the Revised Compensation and Position Classification System and other pertinent budget and compensation laws governing hours of service and such other duties and conditions as it may deem proper; to grant them, as its discretion, leaves of absence under such regulations as it may promulgate, any provision of existing laws to the contrary notwithstanding; and to remove them for cause in accordance with the requirements of due process of law; to grant them honoraria, other remuneration and financial incentives for extra services rendered to the school;

k) To approve the curricula, instructional programs, and rules of discipline drawn by the Administrative and Academic Councils as herein provided;

l) To set policies on admission and graduation of students;

m) To award honorary degrees upon persons in recognition of their outstanding contribution in the fields of education, public service, arts, science and technology, agriculture, or in any field of specialization within the academic competence of the University; and to authorize the awarding of certificates of completion of non-degree and nontraditional courses;

n) To establish and absorb non-chartered tertiary institutions within the Province of Surigao del Sur as branches and centers in coordination with the Commission on Higher Education (CHED), and in consultation with the Department of Budget and Management (DBM), and to offer herein programs or courses to promote and carry out equal access to educational opportunities as mandated by the

o) To establish research and extension centers of the University where such will promote the development of the latter;

p) To establish professorial chairs in the University and to provide fellowships for qualified faculty members and scholarships to deserving students;

q) To delegate any of its powers and duties provided for hereinabove to the University President and/or other officials of the University as it may deem appropriate, so as to expedite the administration of the affairs of the University;

r) To authorize an external management audit of the University to be financed by the CHED, subject to Commission on Audit (COA) rules and regulations; and to institute reforms including academic and structural changes on the basis of the audit results and recommendation;

s) To collaborate with other governing boards of the state colleges and universities within the Province of Surigao del Sur or Region XIII (CARAGA), under the supervision of the CHED and in consultation with the DBM, and work towards the restructuring of the University to become more efficient, relevant, productive and competitive;

t) To enter into joint ventures with business and industry for the profitable development and management of the economic assets of the University, the proceeds from which shall be used for the development and strengthening of the University;

u) To develop consortia and other economic forms of linkages with local government units (LGUs), institutions and agencies, both public and private, local and foreign, in the furtherance of the purpose and objectives of the University;

v) To develop academic arrangements for institutional capability building with appropriate institutions and agencies, public and private, local and foreign, and to appoint experts/specialists as consultants, part-time or visiting or exchange professors, scholars or researchers as the case may be; cIADaC

w) To set up the adoption of modern and innovative modes of transmitting knowledge such as the use of information technology, the dual learning system, open learning or distance education, community laboratory, etc., for the promotion of greater access to education;

x) To establish policy guidelines and procedures for participative decision-making and transparency within the University;

y) To privatize, where the most advantageous to the University, management of non-academic services such as health, food, security, building or grounds or property maintenance and such other similar activities; and

z) To extend the term of the President of the University beyond the age of retirement but not beyond the age of seventy (70), whose performance has been unanimously rated by the governing board as outstanding, after unanimous recommendation by the search committee.

In addition, the Board shall review, confirm and/or take appropriate actions in all contracts, deeds, agreements or instruments entered into by the University President with other entities subject to the limitations provided under the IRR and University

SECTION 19. Minimum Qualifications, Standards, Requirements and Selection Process of the Prominent Citizens. The Board shall appoint two (2) prominent citizens from among the list of at least five (5) qualified persons in the Province of Surigao del Sur, whose nominations were submitted to the Board after publication to the regional print and non-print media for at least two (2) consecutive weeks, as recommended by the search committee constituted by the University President, in consultation with the Chairperson of the CHED and the other members of the Board based on the normal standards and qualifications for the position set by the Board.

The SDSSU Board of Regents shall take into consideration the qualifications and the weight of their possible contribution vis- -vis knowledge, expertise and depth and breathe of experience to the deliberations of the Board and to the realization of the mission of the University itself.

After the two (2) private sector representatives shall have been selected by the SDSSU-Board of Regents by an affirmative majority vote by the Board during the meeting called for that purpose, they shall be appointed by it through a Resolution. The appointment of the private sector representatives should be signed by the Chairperson of the SDSSU-Board of Regents, whether CHED Chair or Commissioner.

The two (2) duly appointed private sector representatives shall assume office after taking their oaths before the CHED Chairperson or the CHED Commissioner as Chair of the SDSSU-Board of Regents or before his/her duly designated representative.

SECTION 20. Term of Office of the President of the Federation of Faculty Associations, President of the Federation of Student Councils, President of the Federation of Alumni Associations and Private Sector Representatives. The term of office of the President of the Federation of Faculty Associations, President of the Federation of Student Councils, and President of the Federation of Alumni Associations, shall be co-terminous with their terms of office in such capacities in accordance with their respective

The two (2) private sector representatives shall serve for a term of two (2) years each. They may be re-appointed for another term only upon approval by an affirmative majority of the SDSSU-Board of Regents. Provided, That they shall be favorably endorsed by the University President after proper consultation with the Chairperson of the SDSSU-Board of Regents.

SECTION 21. Succession in the Representation to the SDSSU-Board of Regents by the Faculty, Student and Alumni Sectors. In the event that the President of the Federation of Faculty Associations loses his/her employment status by way of resignation, retirement, dismissal or transfer from the University or such other causes, or in case the President of the Federation of Student Councils loses his/her status as a bona fide student by way of graduation, resignation, dismissal, expulsion, transfer or such other causes, or if the President of the Federation of Faculty Association loses his/her authority to hold the position by way of resignation or such other causes, then the representation of their sector shall be in accordance with the succession of the officers provided in their respective

Provided, That should there be questions on the succession of officers in any sector, and to avoid hiatus in the representation of any sector, a special election shall be conducted for the representative of the sector after due consultation with the stakeholders of the sector concerned.

The student representative shall be a bona fide student during the conduct of election and the semester or school year of his/her representation to the Board. If he/she has not yet graduated from the University, he/she shall still act as the student regent even during summer of that school year and until the next election of the following year. EcDSTI

The duly elected representatives shall be eligible to represent their respective sectors to the Board with all the rights of a regular member within the period prescribed by the Board upon the recommendation by the University President.

SECTION 22. Meetings and Quorum of the Board. The Board shall regularly convene at least once every quarter. However, the Chairperson of the Board may, upon three (3) days prior written notice, call a maximum of two (2) special meetings whenever necessary.

A quorum of the Board shall consist of a majority of all its members holding office at the time of the meeting: Provided, however, That the Chairperson of the Board or the President of the University is among those present in the meeting.

SECTION 23. Representatives of Board Members Coming from the Government. In the absence of the CHED Chairperson, a Commissioner of the CHED, duly designated by him/her, shall represent him/her in the meeting with all the rights and responsibilities of a regular members: Provided however, That during this meeting, the President of the University as Vice Chairperson shall be the Presiding Officer: Provided further, That this proviso notwithstanding, the Chairperson of the CHED is hereby authorized to designate a CHED Commissioner as the regular Chair of the Board in which case said CHED Commissioner shall act as the Presiding Officer.

In case the Chairpersons of the Congressional Committees on Education shall not be able to attend the Board meeting, they may duly designate their respective representatives to attend the said meeting, who shall have the same rights and responsibilities as a regular member of the Board.

SECTION 24. Presiding Officer. The CHED Chairperson or the CHED Commissioner as duly designated Chair in his/her capacity as Chairperson of the SDSSU-Board of Regents shall preside over the regular meetings or special sessions thereof, except as hereinafter provided for.

In the absence of the CHED Chairperson or the CHED Commissioner as Regular Chair of the SDSSU-Board of Regents, the University President, who is the Vice-Chairperson of its Board, shall preside in a particular meeting.

SECTION 25. Approval of Urgent Resolutions through Referendum. The University President may request approval through referendum of any urgent resolution/s or matter/s necessary or incidental to the realization of the mandates, vision, mission and objectives to ensure continuity in the delivery of the services of the University that require immediate action prior to the holding of the en banc meeting, provided the said Board resolution shall have the same legal effect as approved by the Board of Regents en banc.

SECTION 26. Rights and Responsibilities of Board Members, and No Compensation for the Chairperson, Vice-Chairperson and Members of the Board. The Board members shall have all the normal rights and responsibilities of a regular member of the Board of Directors/Board of Regents of non-profit, non-stock corporations.

The Board Chairpersons, Vice Chairperson and the members coming from the government have the right to sit as Chair, Vice-Chairperson and as members thereof ipso facto upon their assumption into office.

The Chairperson, Vice Chairperson and Members of the Board shall not receive any salary but shall be entitled to reimbursements for actual and necessary expenses incurred, either in their attendance to meetings of the Board or in connection with other official business authorized by resolution of the Board, subject to existing laws and regulations.

SECTION 27. Entitlement of Honorarium and Other Benefits of the Chairperson, Vice-Chairperson and Members of the Board, its Resource Persons, Consultants and Duly Constituted Committees. The Chairperson, Vice-Chairperson and Members of the Board shall be entitled to reasonable honorarium in their attendance during meetings of the Board and other approved benefits for the University.

The Resource Persons and the Committees duly constituted by the Board shall likewise be entitled to reasonable honorarium in their attendance during meetings and such other incidental activities. Provided, That the rate of honorarium shall be in accordance with the guidelines promulgated by the Department of Budget and Management (DBM) and such other relevant issuances thereof.

RULE VIII

The University President

SECTION 28. Minimum Qualifications and Requirements. The University shall be headed by a President, who shall render full-time service. He/She shall be appointed by the Board, subject to the guidelines, qualifications and/or standards set by the Board, upon recommendation of a duly constituted search committee. He/She shall have a term of four (4) years and shall be eligible for a reappointment for another term. Provided, That in order to effect a smooth transition to a state university, the incumbent President of the Surigao del Sur Polytechnic State College, if qualified, shall serve as the first President of the University. ICAcaH

SECTION 29. Selection Process. Within six (6) months before the expiration of the term of office of the incumbent President of the University, the Board shall constitute the Search Committee for the Presidency (SCP).

The composition of the SCP shall be determined by the Board taking into consideration representatives from the academic community, a private sector representative, and a CHED representative.

The SCP so constituted shall recruit and screen applicants for the Presidency and may devise its own procedures for the search.

The SCP shall submit the names of at least three (3) nominees to the Board citing therein the qualifications, capacities, capabilities and strengths of the nominees for guidance and information of the Board as well as the enumeration and description of the criteria and procedures employed in their search.

SECTION 30. Appointment and Terms of Office of the University President. After the Board shall have selected and appointed the University President by a majority vote of the members present in a meeting called for that purpose. His/her appointment papers shall be signed by the CHED Chairperson or the CHED Commissioner duly designated as Regular Chair of the Board.

The University President appointed by the Board shall have a term of four (4) years, the beginning and end of which must be clearly specified in the appointment by the Board.

SECTION 31. Re-appointment and Extension of the Term of Office of the University President. The University President shall be eligible for re-appointment for another term only subject to the review of the performance and such other requirements set forth by the Board. An affirmative absolute majority vote of the Board of Regents shall be required to re-appoint a University President.

The Board may extend the services of the incumbent President of the University beyond the retirement age but not later than the age of seventy (70), whose performance has been unanimously rated as outstanding and upon unanimous recommendation by the search committee for the President of the University duly created by the Board.

SECTION 32. Appointment of New University President After Vacancy Occurs. In case a new University President is appointed by the Board after a permanent vacancy occurs in the Office of the President during the term of office of the original appointee, the new University President as his/her successor shall hold office only for the unexpired portion of his/her term. Provided, That this service for unexpired term shall not however, count as one (1) full term for purposes of appointment/re-appointment.

SECTION 33. Powers and Duties. The powers and duties of the President of the University, in addition to those specifically provided in this IRR, shall be those usually pertaining to the Office of the President of similar universities, and those delegated by the Board.

Corollary, the University President shall be the Chief Executive Officer (CEO) of the University with the following specific powers, functions, duties and responsibilities:

1. Carry out the general policies laid down by the Board and shall have the power to act within the ambit of said general policies, and shall have general supervision of all business and financial operations of the University. He/She shall direct or assign the details of executive action.

2. Hold all officers, faculty members, and employees to the full discharge of their duties and if in his/her sound judgment the necessity arises, he/she shall, after, consultation with the Vice President(s)/Director(s)/Dean(s) concerned, in proper cases, initiate the necessary proceedings for the disciplinary sanctions and/or separation from the service of any of them. Relative thereto, all officers, members of the teaching staff, and employees shall be responsible to and under the direction of the University President.

3. Serve as the official medium of communication between the faculty, employees and students of the University on one hand, and the Board on the other hand.

4. Determine and prepare the agenda of all meetings of the Board, Academic Council and Administrative Council. Provided, That the academic or administrative council by majority vote in their meeting or upon the written request of 1/10 of its membership may include any other item in the agenda.

5. Temporarily suspend the permit issued to any person, natural or judicial, who is engaged in any activity in the University found to pursue any of the following:

a. To arouse disloyalty to the University and/or government;

b. To discourage students from attending their classes and other activities of the University;

c. To create covert act of dissension among students, faculty and employees;

d. To interfere directly or indirectly with the discipline in the University; and

e. To create atmosphere of subversion and rebellion in any of the SDSSU Campuses. If evidence so warrants, the University President may permanently cancel the said permit after informing the Board of his/her action and the Board may take any action that it may deem appropriate in connection therewith.

6. Preside at commencement exercises and other public programs and official functions of the University and confer such degrees and honors as granted by the Board. All diplomas and certificates issued by the University shall be signed by him/her and the University Registrar.

7. Subject to the authority given to him/her by the SDSSU-BOR, recommend suitable persons to fill up vacancies and new positions in the University. He/She shall have the authority to fill up vacancies temporarily upon recommendation by the appropriate Selection Committee; to make such appointments as permitted/delegated by the Board; and to make such other appointments necessary to meet emergencies occurring between meetings of the Board so that the work of the University will not be hampered, provided, that such arrangements are reported to the Board for confirmation or appropriate action at its next meeting.

Whenever vacancies occur, the University President shall make public announcement of such vacancies for better selection and recruitment of qualified persons to fill up vacancies or new positions. EAISDH

No new vacant position and/or item in the University shall be filled in without prior authorization from the University President.

8. Submit an annual report to the Board on the work of the past year and needs for the current year. He/She shall also present to the Board the annual budget of the University with estimates of income and expenditures including the short, medium and long-term development and investment plans.

9. Upon authority of and subject to confirmation by the SDSSU-BOR, execute and sign on behalf of the University all contracts, agreements, deeds and other instruments necessary for the proper conduct of the business of the University.

However, in recurring undertakings and transactions where his/her action is virtually ministerial, conditions and terms thereof having been fixed by existing regulations and general laws, he/she may direct through appropriate written instructions that approval in specified cases maybe made in his/her behalf by the officers of administration or heads of units, subject to such safeguards as he/she may impose.

10. The University President shall discharge the following specific duties, authorities and powers in accordance with existing laws, rules and regulations.

a. Accept resignation of the officials, faculty members and employees;

b. Grant or deny leaves of absence and/or such leaves;

c. Recommend to the Board of Regents the retirement of members of the faculty and employees upon application of the personnel concerned;

d. Authorize the transfer of faculty members and employees from one department or unit in the university to another in the interest of the service. Provided, that the personnel concerned is notified before such transfer is made;

e. Subject to the approval by the Board, he/she may approved/disapprove permit for faculty/employees to attend or undergo training, grants, fellowships, scholarships, assistantships, or conferences sponsored by outside agencies/organizations;

f. Supervise and control, through the Vice Presidents for Academic Affairs and College Deans, all academic programs and activities of the University; cluster courses and units, authorize the same and the issuance of adequate rules for the operations of the Colleges and Departments; and require all concerned administrators to submit monthly reports of accomplishments;

g. Subject to the approval by the Board, grant or deny the extension of fellowship/scholarship/training for a period not beyond one (1) academic year if the budget permits and for reasons he/she may deem satisfactory;

h. Authorize the promulgation of such rules which in his/her judgment are necessary for the safekeeping and proper disbursement of funds or property of all student organizations officially approved or recognized to examine and audit the accounts pertaining to such funds or property;

i. When so authorized by the Board, appoint, without the necessity of submitting to the Board for approval, qualified members of the faculty as fellow of the University (full or partial) in order to enable them to pursue graduate studies abroad, and to fix the financial assistance to such fellows in accordance with the rules promulgated by the Board, and within the lump sum appropriated for fellowships;

j. Issue ad-interim appointments or designations when the interest of the services so requires; and

k. Subject to the Board's approval, renew appointments of the employees concerned for not more than one (1) year if the budget permits and the services are necessary.

11. Perform other powers, duties, responsibilities and functions as expressly stipulated in the University

SECTION 34. Filling-up of Vacancy of the Presidency. In case of vacancy in the Office of the President by reason of death, compulsory retirement, resignation, removal for cause or incapacity of the University President to perform the functions of his/her office, the Board shall have the authority to designate an Officer-In-Charge of the University pending the appointment of a new University President.

In case of vacancy in the Office of the President, as mentioned in the immediately preceding paragraph, his/her successor or the Officer-In-Charge shall serve only the unexpired portion of the term. He/She shall perform the powers, duties and responsibilities of regular University President in so far as authorized by the Board.

Provided, That in the event, the Board cannot meet for the purpose of filling-up the vacancy as mentioned above, the CHED Chairperson or the CHED Commissioner as Chair of the Board of Regents shall, within fifteen (15) days from the occurrence of such vacancy, designate an Officer-In-Charge (OIC) in the Office of the President of the University, subject to the confirmation by the Board. aCHcIE

SECTION 35. Compensation and Benefits. The salary of the University President shall be in accordance with the Revised Compensation and Position Classification System and shall be comparable to that being received by the President of similar higher educational institutions.

The University President shall likewise be entitled to full retirement benefits under existing laws.

Furthermore, the President of the University shall be entitled to Representation and Transportation Allowances (RATA) and such other benefits based on the rates prescribed by the DBM.

SECTION 36. Fall-Back Position of the Incumbent University President. The incumbent President of the University shall have an automatic fall-back position to the appropriate academic and or position in accordance with the provisions of DBM Circulars and CSC laws, rules and regulations. Within six (6) months before the expiration of the term of office of the University President, the Human Resource Management Officer of the University shall process necessary documents to ensure his/her entitlement of a fall-back position.

RULE IX

The Vice Presidents, Campus Directors, Directors, University Deans and Other Officials

SECTION 37. Appointment. The University President shall, upon authority by the SDSSU-Board of Regents, appoint the Vice-Presidents, Campus Directors, Directors, University Deans and other officials from the faculty members and employees of the University. Provided, That those administrative positions covered by specific laws or guidelines shall be appointed in accordance with the provisions therein.

The University President shall be assisted by a Vice-President for Academic Affairs, a Vice President for Administration and Finance and Vice President for Research, Planning, Extension, and External Affairs. Provided, That the University President may cause for the reclassification of the positions of the Vice Presidents subject to the confirmation by the Board.

Each College of the University shall be headed by a Dean. The major programs and functions of the University such as, but not limited to planning and quality assurance management, research, extension, production, auxiliary services, external affairs, student affairs and services, academic related services, financial management, administrative services, engineering and maintenance services, and management information system shall be headed each by a Director.

The University President shall issue appropriate special orders to effect the appointment of Vice Presidents, Directors, Deans, Heads, Section Chiefs, Supervisors, Chairpersons, Coordinators and other officials of the University.

SECTION 38. Duties and Responsibilities. The University President shall prescribe the duties and responsibilities of the Vice Presidents, Campus Directors, Directors, University Deans, Heads, Supervisors, Chairpersons, Coordinators and other officials in accordance with the provisions of the University IDATCE

SECTION 39. Term of Office. The term of office of the Vice Presidents, Campus Directors, Directors, Deans, Heads, Supervisors, Chairpersons, Coordinators and other officials of the University shall be subject to existing laws, rules and regulations.

SECTION 40. Entitlement of Representation and Transportation Allowance and Honorarium. The Vice Presidents, Campus Directors, Directors and University Deans may be entitled to a monthly Representation Allowance and Transportation Allowance (RATA) in accordance with the provisions of DBM circulars, rules and regulations and shall be entitled a reduced teaching load as provided in the GAM or University

Provided, That the other officials who are not covered by DBM Circulars, rules and regulations may be granted with reasonable honorarium and a reduced teaching load as the University President may prescribe as provided in the University

Provided, further, That the amount necessary to support the grant for RATA and honorarium may be charged from appropriate funds of the University subject to applicable laws, rules and regulations and approved by the SDSSU Board of Regents.

RULE X

Heads of University Campuses

SECTION 41. Minimum Qualifications and Requirements. Campus Directors shall head the University Campuses and they shall render full-time service. They shall be appointed by the Board, upon recommendation of the search committee and the University President, subject to the guidelines, qualifications set by the Board. Provided, That the incumbent College administrators of the external campuses shall serve as Campus Directors of their respective campuses.

SECTION 42. Appointment and Terms of Office of the Campus Director. After the Board appoints the Campus Director by an affirmative majority vote of the members present, his/her appointment papers shall be signed by the University President. Upon issuance of a special order by the University President, the Campus Director appointed by the Board shall have a term of three (3) years. cHESAD

SECTION 43. Re-Appointment of the Campus Director. The Campus Director shall be eligible for re-appointment for another term only subject to the review of the performance and such other requirements set forth by the University President and the Board. An affirmative majority vote of the Board of Regents shall be required to appoint a Campus Director upon favorable recommendation by the University President.

SECTION 44. Compensation and Benefits. The salary of the Campus Director shall be in accordance with the Revised Compensation and Position Classification System or his/her equivalent faculty rank classification.

The Campus Director shall likewise be entitled to full retirement benefits under existing laws. Furthermore, the Campus Director of the University shall be entitled to Representation and Transportation Allowances (RATA) and such other benefits based on the rates prescribed by the DBM.

SECTION 45. Duties and Responsibilities of the Campus Directors. The Campus Directors shall discharge the duties and responsibilities as the University President may prescribe in accordance with the provisions of the revised University Governance and Administration Manual (GAM) or the University

RULE XI

The Administrative Council

SECTION 46. Composition, Powers and Duties. There shall be an Administrative Council consisting of the President of the University as Chairperson, vice presidents, university deans, campus directors, directors and other officials of equal rank as members, whose duty is to review and recommend to the Board the policies governing the administration, management and development planning of the University.

The Administrative Council shall have a Secretary to be designated by the University President from the Officials or faculty members of the University. The duly designated Secretary shall keep all records and proceedings of the Administrative Council, serve upon each member of the Administrative Council the appropriate notice of the meetings, and discharge such other duties and responsibilities as the Administrative Council and/or University President determine.

SECTION 47. Meetings and Quorum. The University President shall fix the schedule and venue of every meeting of the Administrative Council. A quorum for any meeting of the members shall consist of a majority of the members and a majority of such quorum may decide any question at the meeting, except those matters that require the affirmative vote of a greater proportion as prescribed by relevant laws, rules and regulations.

SECTION 48. The Administrative Council duly constituted by the University President may formulate and promulgate internal rules of procedures to ensure proper and orderly conduct of its business and meetings.

RULE XII

Academic Council

SECTION 49. Composition. There shall be an Academic Council to be composed of the President of the University, who shall act as Chairperson; and all academic staff with the rank of at least assistant professor, as members.

The Academic Council shall have a Secretary to be designated by the University President from the officials or faculty members of the University. The duly designated Secretary shall keep all records and proceedings of the Academic Council, serve upon each member of the Academic Council the appropriate notice of the meetings, and discharge such other duties and responsibilities as the Academic Council and/or the University President may determine.

SECTION 50. Powers. The Academic Council shall have the power to review and recommend the curricular offerings and rules of discipline of the University subject to the approval of the Board. It shall fix the requirements for the admission of students, as well as for graduation and conferment of degrees, subject to review and/or approval by the Board through the President of the University. It shall have the disciplinary power over students of the University and shall formulate academic policies and rules and regulations on discipline, subject to the approval of the Board.

SECTION 51. Meetings and Quorum. The University President shall fix the schedule and venue of every meeting of the Academic Council. A quorum for any meeting of the members shall consist of a majority of the members and a majority of such quorum may decide any question at the meeting, except those matters that require the affirmative vote of a greater proportion as prescribed by relevant laws, rules and regulations.

SECTION 52. The Academic Council duly constituted by the University President may formulate and promulgate internal rules of procedures to ensure proper and orderly conduct of its business meetings.

RULE XIII

University and Board Secretary

SECTION 53. The Secretary of the Board and University. The Board shall appoint a secretary, who shall serve as such for both the Board and the University and shall keep all records and proceedings of the Board and the Councils. However, he/she shall be responsible for disseminating appropriate and proper information and updates on Board actions and observe transparency except on confidential matters which need approval from the University President.

He/she shall serve upon each member of the Board the appropriate notice of meetings. He/she shall observe the

In addition, the University and Board Secretary shall discharge such other duties and responsibilities as the University President and/or the Board may prescribe.

RULE XIV

Promulgation and Implementation of Policies

SECTION 54. Promulgation and Implementation of Policies. The Board shall promulgate and implement policies in accordance with the declared State policies on education and other pertinent provisions of the

All service manuals, policies and guidelines necessary and incidental to ensure proper implementation of the mandates, vision, mission, objectives, programs and plans of the University shall be reviewed and approved by the Board. TDAcCa

RULE XV

The Faculty

SECTION 55. Prohibitions in the Selection of Faculty. No political beliefs, gender preference, cultural or community affiliation or ethnic origin, and religious opinion or affiliation shall be a matter of inquiry in the appointment of faculty members of the University.

SECTION 56. Appointment, Compensation and Other Benefits of Faculty Members. The appointment of any faculty member shall be subject to the guidelines, qualifications and/or standards set by the Board: Provided, further, That no member of the faculty shall teach for or against any particular church or religious sect. Faculty members of the University shall be entitled to compensation and other benefits authorized by the SDSSU Board prescribed under existing laws, rules and regulations. They may also be entitled to honorarium for overload services with pay and for their actual involvement in research, extension and production services and related programs, projects or activities in accordance with applicable laws, rules and regulations in so far as authorized by the SDSSU-Board of Regents upon the recommendations by the University President.

RULE XVI

Scholarship Program/Admission

SECTION 57. Admission. No student shall be denied admission to the University by reason of sex, religion, cultural or community affiliation or ethnic origin.

SECTION 58. Scholarship Program. The University shall provide scholarship programs and other affirmative action programs to assist poor but deserving students who qualify for admission to the University.

RULE XVII

Academic Freedom and Institutional Autonomy

SECTION 59. Academic Freedom and Institutional Autonomy of the University. The University shall enjoy academic freedom and institutional autonomy pursuant to paragraph 2, Section 5 of Article XIV of

SECTION 60. Academic Freedom of Faculty Members and Students. Faculty members and students of the University shall enjoy academic freedom as provided for under this IRR and such other applicable laws.

RULE XVIII

Treasurer of the University

SECTION 61. The Treasurer of the University. The Treasurer of the Philippines shall be the ex-officio Treasurer of the University.

SECTION 62. The Board of Visitors of the University. The Board of Visitors of the University shall consist of the President of the Philippines, Congressional Leaders of the Congress of the Philippines, Chairperson of the Commission on Higher Education and the CHED Commissioner designated as regular Chairperson and Presiding Officer of the Board.

RULE XIX

Authority to Loan or Transfer Apparatus/Equipment/Supplies and Detail of Personnel

SECTION 63. Authority to Loan or Transfer and Detail. The heads of the bureaus and offices of the national government are hereby authorized to loan or transfer, upon the request of the President of the University such apparatus, equipment or supplies as may be needed by the University, and to detail employees for duty therein, when, in the judgment of the head of bureau or office, such apparatus, equipment, supplies or services of such employees can be spared without serious detriment to public service.

The employees so detailed shall perform such duties as required of them by the President of the University and the time so employed shall be counted as part of their regular services.

RULE XX

Assets, Liabilities and Personnel

SECTION 64. Transfer of Assets and Liabilities. All assets, real and personal, personnel and records of the Surigao del Sur Polytechnic State College, as well as liabilities or obligations, are hereby transferred to the University.

SECTION 65. Positions, Rights and Security of Tenure of Personnel. The positions, rights and security of tenure of the personnel therein employed under existing laws prior to the conversion into a University shall be respected.

Provided, That the University President is authorized to transfer or detail any faculty member or employee, subject to relevant CSC laws, rules and regulations, to further improve the quality in the delivery of services and the realization of the mandates, vision, mission, and objectives of the University.

SECTION 66. Selection and Appointment of Personnel. The selection and appointment of any personnel of the University Campuses shall be subject to the guidelines, qualifications and/or standards set by the CSC, CHED and the Board.

The selection, appointment, promotion and such other personnel action in all University Campuses shall be subject to the policies, guidelines, qualifications and/or standards set forth by the Board. Appointment of personnel shall be signed by the proper officials and duly approved by the University President.

SECTION 67. Compensation, Scholarships and Other Benefits. Officials, administrators, teaching and non-teaching personnel of the University shall be entitled to compensation, scholarships and other benefits stipulated in the Collective Negotiation Agreement (CNA), those authorized by the SDSSU Board of Regents (BOR), and those prescribed under existing laws, rules and regulations.

They shall also be entitled to honorarium for overload services and allowances for their actual involvement in research, extension, and production services, related programs, projects or activities in accordance to applicable laws, rules and regulations in so far as authorized by the SDSSU Board of Regents upon the recommendation by the University President.

SECTION 68. Ownership and Titling of Properties. All parcels of land belonging to the government occupied by the Surigao del Sur Polytechnic State College are hereby declared to be property of the University, and shall be titled under the name: Provided, that should the University ceases to exist or be abolished or should such parcels of land aforementioned be no longer needed by the University, the same shall be reverted to the national government.

The University President shall cause for the immediate lifting of the aforementioned properties in accordance with existing laws, rules and regulations.

RULE XXI

Appropriations and Financial Management

SECTION 69. Appropriations. The amount necessary to carry out the initial implementation of aETDIc

SECTION 70. Financial Management. The financial management of the University shall be in accordance with existing laws, rules and regulations.

Provided, that the University shall exercise reasonable flexibility on the use of its internally generated income to augment its operations and finance the expenses necessary and incidental to the proper implementation of its major functions.

RULE XXII

Development Plan, Management Audit, Organizational/Administrative/Academic Structure

SECTION 71. Development Plan, Management Audit, Organizational/Administrative/Academic Structure. Within the period of one hundred twenty (120) days after the approval of this Act, the University shall accomplish the following:

a)Submit a five (5) year development plan, including its corresponding program budget to the CHED, for appropriate recommendation to the DBM;

b)Undergo a management audit in cooperation with the CHED; and

c)Accordingly set up its organizational, administrative, as well as academic structure including the appointment of the key officials of the University.

RULE XXIII

CHED Monitoring and Evaluation

SECTION 72. Conduct of Evaluation. The CHED shall conduct regular monitoring and evaluation to determine continuing compliance with the requirements on University status. Provided, that the University shall be given prior notice on the conduct of the evaluation.

SECTION 73. Appeal and Implementation of Recommendation. Any recommendation of CHED which may adversely affect the University status shall not preclude the right of the University to appeal before the CHED, Senate Committee on Education, Arts and Culture, and the House Committee on Higher and Technical Education in accordance with existing laws, rules and regulations.

SECTION 74. Compliance. The University shall be given reasonable time to fully comply the recommendations by the CHED. As much as practicable, the University shall submit appropriate reports to the CHED, the Senate Committee on Education, Arts and Culture, and the House Committee on Higher and Technical Education for its continuing implementation of the recommendations and compliance on the requirements of the University Status.

RULE XXIV

Filing of Report

SECTION 75. Filing of Report. On or before the Fifteenth (15th) day of the second (2nd) month after the opening of the regular classes each school year, the Board shall file with the Office of the President of the Philippines through the Chairperson of the CHED and with both Houses of Congress a detailed report on the progress, conditions and needs of the University.

Provided, That the University President through its duly designated authorized officials shall facilitate the preparation and submission of the appropriate report.

RULE XXV

Conferment of Honorary Degrees and Special Awards

SECTION 76. General Provision. The Board is authorized to award honorary degrees and special awards upon persons in recognition of outstanding contributions in the field of education, public service, arts, science and technology or any field of specialization within the academic competence of the University.

The honorary doctorate degree shall be conferred upon persons who have attained exceptionally meritorious achievements in the arts, the sciences, the humanities, and/or public services with tangible and relevant accomplishments. The conferment of honorary degree by the University shall be entitled to two (2) honorary degrees per year except in cases when a prior written approval is granted by the Commission on Higher Education (CHED) En Banc for the grant of more than two (2) degrees per year.

Emeritus awards shall also be conferred to retired individuals with previous administrative and academic functions in recognition of exemplary performance, accomplishments or contributions to education and other fields.

SECTION 77. Policies and Guidelines. The conferment of honorary degrees and special awards by the University shall be in accordance with the policies and guidelines prescribed by the Commission on Higher Education in so far as the Board may determine.

RULE XXVI

Miscellaneous and Transitory Provisions

SECTION 78. Designation, Duties and Responsibilities, and Term of Office of the Vice Presidents, Campus Directors, Directors, Deans of the University System and Other Officials of the University. The University President shall designate from the faculty members or employees the Vice-Presidents, Campus Directors, Directors, Deans of the University System and other officials consistent with the rules and regulations of the Civil Service Commission. Likewise, the University President may call for an election by the members of the Academic and Administrative Councils for officials with no existing or available plantilla positions expressly authorized by the DBM subject to the confirmation by the Board.

The term of office, and the duties and responsibilities of the duly designated officials shall be solely determined by the University President duly approved by the SDSSU-Board of Regents in accordance with the provisions of the revised University Governance and Administration Manual (GAM) or the University Provided, That in exigency of the service, they shall be qualified for re-designation at the sound discretion by the University President.

The University President shall issue appropriate SDSSU Office Orders to effect the designations of the Vice Presidents, Campus Directors, Directors, Deans of the University System and other officials of the University.

SECTION 79. Entitlement of Benefits of Designated University Officials. The duly designated Vice-Presidents, Campus Directors, Directors, and Deans of the University System shall be entitled to a reduced teaching load and a Representation and Transportation Allowance (RATA) in accordance with the rates prescribed by the DBM and such other benefits expressly provided under the revised University Governance and Administration Manual (GAM) or University

Provided, That the duly designated Vice-Presidents, Campus Directors, Directors, Deans of the University System and other officials who are not covered with the grant of RATA shall be entitled to reasonable honorarium and a reduced teaching load as the University President may determine, duly approved by the Board subject to availability of funds and usual accounting and auditing rules and regulations.

SECTION 80. Adjustment or Formulation of the Organizational Structure and Filling-Up of the Positions. The University President shall adjust or formulate the organizational structure of the University and the positions indicated therein shall be filled up in accordance with the provisions of this IRR subject to the review and approval by the Board.

RULE XXVII

Suppletory Application

SECTION 81. Suppletory Application of The provisions of ESDcIA

SECTION 82. Suppletory Application of Relevant Laws, Rules and Regulations. All relevant laws and the rules and regulations as promulgated by the Commission on Higher Education, Civil Service Commission, Commission on Audit and such other competent authority shall apply suppletorily in this IRR in so far as authorized by the SDSSU-Board of Regents.

RULE XXVIII

Parity, Separability and Repealing Clauses

SECTION 83. Parity Clause. All other powers, functions, privileges, responsibilities and limitations to state universities and/or their officials under existing laws shall be deemed granted to or imposed upon the University and/or its officials whenever appropriate.

SECTION 84. Separability Clause. If for any reason, any part or provision of the IRR is declared invalid or unconstitutional, the remaining parts or provisions not affected hereby shall remain in full force and effect.

SECTION 85. Repealing Clause. All resolutions, rules and regulations, memoranda and orders promulgated by the Board and/or by the University President and such other authorities contrary to or inconsistent with the provisions of this IRR are hereby repealed or modified accordingly.

Furthermore, all laws, presidential decrees, executive orders, rules and regulations contrary to or inconsistent with the provisions of this IRR are hereby repealed or modified accordingly.

RULE XXIX

Revision, Amendment and Effectivity

SECTION 86. Revision and Amendments. This IRR may be revised and any part of or provision of the IRR may be amended by the SDSSU-Board of Regents upon the recommendation by the University President. Provided, that a Committee shall be created to study and review any proposal to revise or amend this IRR before the Board may act hereof. The duly approved revised and amended IRR shall be submitted to the CHED for consultation.

SECTION 87. Effectivity. This IRR shall take effect fifteen (15) days after its publication in two newspapers of general circulation in the Philippines.

WE HEREBY CERTIFY TO THE CORRECTNESS OF THE FOREGOING IMPLEMENTING RULES AND REGULATIONS (IRR) APPROVED BY THE SDSSU-BOARD OF REGENTS PER BOARD RESOLUTION NO. 64 SERIES 2011.
